No executions had taken place since 1990. There were 40 inmates on death row in 2002. The head of the Parliamentary Commission on Legal Affairs, Viktor Dallakian, said in July 2002 that the eventual abolition of the death penalty would not be retroactive, but they may be amnestied by the president. The Constitution provides the President with the authority to pardon convicted persons. The death penalty is not applicable to people who were below the age of 18 at the time when the crime was committed and pregnant women or women who were pregnant at the time the crime was committed. Armenia has sponsored the moratorium resolution at the UN High Commission on Human Rights every year since 1997.
