The Constitution of the Federation of Bosnia and Herzegovina does not provide for the death penalty but the Criminal Code does. It provides that severe crimes that are ordinarily punishable by long-term imprisonment may be punishable by the death penalty when committed in a state of war or imminent danger of war.
Conversely, the Constitution of Republika Srpska provides that the death penalty may be pronounced for the most serious crimes. However, there is no provision for the death penalty in the Republika Srpska Criminal Code. Bosnia and Herzegovina abolished the death penalty for ordinary crimes in 1997.
