the convictions and death sentences of Marlon Peters, Ian Little and David George Huggins for the murder of Nigel Singh in 2003, were quashed after their appeals were upheld by Justices of Appeal Paula Mae Weeks, Alice Yorke-Soo Hon and Rajendra Narine.
The appellate judges agreed with the concerns raised by Special Prosecutor Dana Seetahal, SC, on the effects several flaws in the trial judge’s handling of the case, had on the men’s trial.
Among the concerns raised by Seetahal and the men’s attorneys Gilbert Peterson, SC, Larry Lalla and Ian Brooks, were the late hour in which the jury retired to deliberate — after 5.30 pm on a Friday after two days of summation; the admittance of evidence which went against the judges’ rules on how police officers should treat suspects after they have been charged, as well as the judge’s simple warning direction to the jury, after the withdrawal of vital identification evidence by the prosecution.
Weekes, in an oral ruling, said there was none more serious than a trial for murder, and in the case of the three appellants, the Appeal Court could not find that they had received a fair trial in light of the concerns raised. In ordering a retrial, Weeks said the court had to consider the seriousness of the crime, noting also that issues relating to the strength of the prosecution’s evidence, were matters for a trial judge and a jury’s consideration.
Peters, Little and Huggins went on trial in 2009, before Justice Herbert Volney in the San Fernando High Court.
At the end of their trial, they were convicted and sentenced to hang.
It was alleged that they went to Singh’s home at Rancho Quemado, Palo Seco looking for cocaine. Singh was dragged out of the house in the presence of his wife and two children and was shot in a backroad a short distance away from his home.
Jagdeo Singh and Amerelle Francis also appeared for the three men.
