The Military Appeal Court, sitting at its Makindye headquarters, Kampala, upheld a death sentence against a UPDF soldier accused of killing three of his colleagues in the barracks.
But Justice Elly Turyamubona quashed the death sentence against another soldier, Private Godfrey Nuwagaba, from the 57th Battalion in Kasese, on the similar charges.
Turyamubona assisted by Lt. Colonels Jack Mishambi and George Igumba, Maj. Milton Gidudu and Capt. Gordad Busingye, ruled that there was enough evidence in the lower court to convict Pte Raphael Oyet of murder.
Oyet is said to have jumped off his sick bed in Gulu Barracks and gone to friend Francis Olana's home where he shot dead Sgt. Ben Lagoya and privates Situma Wapakala and Peter Mutongwa.
The General Court Martial sent him to the gallows on February 21, 2000.
Nuwagaba, 24, was sentenced to death by the army court sitting at Mbarara. He was accused of shooting dead Pte Simon Gamba with malice and forethought on May 2, 1998 at Bulambaire Army Detach in Kasese.
