The New Mexico Supreme Court overturned the death sentence of Michael Treadway and ordered him to spend life in prison. Treadway had been 1 of 3 men on death row, sentenced for the December 1997 shooting death of Everett Clint "Red" Prather, 73. The court said prosecutors failed to present sufficient evidence that Treadway killed Prather to keep him from reporting a crime, the so- called aggravating circumstance that made Treadway eligible for death. In an unanimous ruling, the 5-member court reversed the death sentence and ordered that a life sentence be imposed.
