The state Supreme Court has ordered attorneys to submit new briefs in 8 death penalty cases in the wake of a U.S. Supreme Court decision that raises questions about Delaware's death penalty law.
The court told prosecutors and defense attorneys for eight death row inmates to submit arguments on the effect in each case, if any, of the U.S Supreme Court's ruling in Ring v. Arizona.
In its June decision, the U.S. Supreme Court overturned sentencing laws in five states where judges act alone in issuing the death penalty.
The order issued Tuesday applies to all death penalty appeals pending before the state Supreme Court.
The appeals were filed on behalf of convicted killers Milton Taylor, Adam Norcross, Sadiki Garden, Joseph Williams, Craig Zebroski, Luis Cabrera, Luis Reyes and Ralph Swann.
Defence briefs are due by Aug. 15, and prosecution briefs by Sept. 16. Defense attorneys must submit any reply briefs by Oct. 1. After reviewing the briefs, the court will determine whether additional briefs or oral argument in any of the cases is required.
