Three dadah traffickers facing the death sentence escaped the gallows when the Court of Appeal allowed their appeals.
Salesman Mohd Taufiq Mani Abdullah had been sentenced to death by the Kangar High Court on August 18, 1994 for trafficking 2.8kg of cannabis at Pasar Padang Besar in Perlis.The appellate court sentenced him to 15 years' jail and 10 strokes of the rotan for dadah possession.
Bar tender Tan Teck Chew, 36, had been sentenced to death by the Kuantan High Court on December 21, 1996, for trafficking 40.11gm of heroin behind the Teruntum Complex in Jalan Mahkota Pahang, Kuantan. In allowing Tan's appeal, the court sentenced him to 15 years' jail and 10 strokes of the rotan for dadah possession.
In the case of Chan Kheng Nam, 37, whose death sentence was commuted to five years' jail and three strokes of the rotan, the court found it difficult to decide the commencement date of the jail term as he had been in custody since 1990. After submissions by Chan's counsel, the bench ruled that the sentence should start from the date of conviction by the High Court.Chan was sentenced to death on July 29, 1995, for trafficking 47.83gm of heroin in Taman Tunas Jaya, Kuantan, on August 21, 1990.
