U.S. District Judge J. Curtis Joyner overturned the death sentence of Joseph J. Kindler. Judge Joyner blamed the reversal on the trial judge's faulty jury instructions and prosecutorial misconduct. Joyner ordered that Kindler, 43, be sentenced to life in prison if he is not given a new sentencing hearing within 6 months. Evidence showed that Kindler, on July 25, 1982, used a baseball bat to bash in the skull of David Bernstein, 22. Authorities said Kindler killed Bernstein, a fellow-burglar, to prevent him from testifying against him in an upcoming criminal trial.
