Multnomah County Circuit Senior Judge Frank Bearden has overturned the May 2000 death sentence of Jeffrey Dale Tiner, 53, white, saying Tiner wasn’t given a proper defense. Tiner was sentenced for the March 1993 murder of James Salmu, 34. Judge Bearden has remanded the case back to Lane County Circuit Court for resentencing. In a seven-page opinion, Bearden wrote that Tiner’s due process rights were violated when his defense lawyers failed to call 2 witnesses at sentencing who were available to “portray a more human and less dangerous side” of the convicted killer.
