A jury in Cincinnati recommended the death sentence for an Ohio inmate convicted of killing a prison guard

A jury in Cincinnati recommended the death sentence for an Ohio inmate convicted of killing a prison guard. The jury recommended execution of 46-year-old James Were for the killing 10 years ago of guard Robert Vallandingham during the Lucasville prison riot. The final sentencing decision is up to Hamilton County Common Pleas Judge Fred Cartolano. He will sentence Were on June 6th. It's the 2nd time Were has been convicted of the guard's murder. The Ohio Supreme Court ruled last year that he should be re-tried because he hadn't received a hearing on whether he was mentally competent to stand trial.
