Dorion Lee Daniel's death sentence, for the 1997 execution-style slayings of Mark Payne and Frederick Washington and attempted murders of 2 others following an argument over $10, was overturned by the Nevada Supreme Court. The high court held unanimously that several errors occurred in the case, among them a private, unrecorded meeting between the trial judge and a prosecution witness and the judge's limiting of defense evidence about the violent character of the victims. Justices also said Clark County District Judge Don Mosley allowed questioning regarding Daniel's prior arrests, and didn't allow questioning of a juror about possible prejudice against Daniel. The Supreme Court said a new trial was warranted because of "the quantity and character of this cumulative error and the gravity of the crime charged and the penalty sought."
