The 10th U.S. Circuit Court of Appeals overturned Billy Keith McGregor's conviction by ruling he was found competent for trial under an unconstitutional standard. The ruling, on a 6-3 vote, said Oklahoma could try McGregor again if he is found competent under a constitutional burden of proof. The ruling comes after a U.S. Supreme Court decision that found unconstitutional an Oklahoma law dealing with the competency of defendants. McGregor was convicted for the murder in 1983 of Virgie Iona Plumb, 57.
