The U.S Court of Appeals for the Fifth Circuit ruled that Texas death row inmate Calvin Burdine's Sixth Amendment right to counsel was violated when his attorney slept through parts of the trial. The full court decided the case after a 3-judge panel of the same court ruled earlier that Burdine's conviction could stand because his lawyer, Joe Cannon, did not sleep through "crucial" parts of the trial.
