In Bartow, a 2nd jury has recommended a death sentence for Thomas Woodel in the fatal stabbing of an elderly Illinois couple on New Year's Eve 1996. Woodel, 34, was convicted in 1998 and sentenced to death for the murders of Clifford Moody, 79, and his 74-year-old wife, Bernice. The Florida Supreme Court in December 2001 upheld the convictions but ordered a new sentencing hearing. The high court said the trial judge failed to expressly evaluate in his sentencing order the mitigating circumstances presented by Woodel's defense attorney, which included childhood abuse and neglect. A new jury ruled that Woodel receive life in prison without parole for one of the murders and a death sentence in the other. A judge makes the final decision. The sentencing hearing is scheduled for September.
